Mediation in the United States
The United States has one of the world’s most developed mediation frameworks, with both court-connected and private mediation services operating across all 50 states. Family mediation has grown significantly since the 1980s, with many states now requiring mediation before divorce or custody proceedings can advance to trial. Commercial mediation is widely used in business disputes, employment matters, and civil litigation, supported by the Uniform Mediation Act which has been adopted by multiple states to ensure confidentiality and enforceability of mediated agreements.
